The DMV Refusal Hearing

If you have been arrested for drunk driving in New York City and refused a breathalyzer test, your license will be suspended until there is a refusal hearing at the Department of Motor Vehicles. The hearing will take place withing 15 days of your arraignment and will happen in lower Manhattan at 19 Rectors Street, Second Floor. If the police officer does not appear at the first hearing, it will be rescheduled and you will be given your license back.

At the second hearing the hearing will go forward with or without the police officer. You also have the right to testify at this hearing. Here is where The Law Offices of Michael S. Discioarro, LLC can be helfpful. We have amassed an impressive number of victories at these hearings and are ready to help you. While this is not a criminal matter, if you don't win this hearing, DMV will take your driving priveleges way for one year- and nothing can be done about it.

If you are facing a refusal hearing at DMV, contact The Law Offices of Michael S. Discioarro, LLC at 917-519-8417 and let us work for you.
